1. Introduction
Welcome to WhoBuilt ("WhoBuilt", "we", "our", or "us"). These Terms and Conditions ("Terms") govern your access to and use of our website and services ("Platform"). By using WhoBuilt, you agree to comply with and be bound by these Terms.

2. Overview of Services
WhoBuilt is an online platform for Australian building professionals to showcase and promote construction projects. General users may browse content, follow professionals, and interact with published projects.

* Only Australian-based building professionals may create professional accounts and upload project content.
* General users, including those outside Australia, may create standard accounts to browse and engage with content.
* Viewer accounts may be free or paid. Paid viewer subscriptions, where offered, may provide access to additional features and are not professional accounts.

3. Account Registration and Use
* Users and professionals must be 18 years or older to register.
* You must provide accurate and complete information during sign-up.
* You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

4. Subscription Terms

4.1 Free and Paid Tiers
WhoBuilt offers free and paid subscription tiers for professional accounts and viewer accounts. Feature access and availability vary by account type and subscription tier. Professional subscriptions are available only to Australian-based building professionals. Viewer subscriptions may be purchased by users worldwide.

4.5 Goods and Services Tax (GST)
All prices for subscriptions are stated exclusive of GST unless stated otherwise. If GST becomes payable on any supply we make to you, we may add GST to the subscription price in accordance with Australian tax law. You agree to pay the GST amount in addition to the base subscription fee. Any GST charged will be shown clearly at checkout or on your invoice. Fees are quoted in AUD. Users are responsible for any currency conversion or bank fees.

4.6 Changes to Subscription Prices
We may change our subscription prices from time to time for reasons other than taxes (for example, changes to features or services). If we do, we will give you reasonable notice of 14–30 days before the change takes effect. Any price change will apply from your next billing date after the notice period. If you do not agree to the new price, you may cancel your subscription before the change takes effect, and you will not be charged the increased amount.

5. User-Generated Content

5.1 Content Ownership & License
Professionals retain ownership of content uploaded ("User Content"). By uploading content, you grant WhoBuilt a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use, reproduce, display, adapt, promote, and distribute your content across digital and physical media for advertising, promotional, and commercial purposes.

5.2 Consent to Media Use
By accepting these Terms, you explicitly consent to WhoBuilt using your uploaded content (including personal information and project data) in promotional campaigns, advertisements, media publications, and public communications. Once published, such content will not be removed even if the associated profile or uploads are deleted.

5.3 Public Visibility
Uploaded content is generally visible to the public. Professionals may choose to hide their email, phone number, or business address via their account settings.

5.4 Analytics Access
Analytics are provided for informational purposes only and may vary in accuracy.

6. Copyright and Infringement
You must own the rights or have the necessary permission to upload any content to WhoBuilt. If you believe someone has uploaded your copyrighted material without permission, contact us at info@whobuilt.com.au with a description of the work, proof of ownership, and a link to the content in question.

7. Acceptable Use
You agree not to:

* Upload false, misleading, or illegal content
* Misrepresent your identity or business
* Attempt to interfere with or damage the Platform
* Harass, abuse, or spam other users
* Copy, extract, reproduce, or reuse any content from WhoBuilt, including images, text, project data, or business information, whether manually or via automated means, without prior written permission. Violation may result in account suspension, termination, or legal action.

8. Termination and Suspension
WhoBuilt reserves the right to warn, suspend, or terminate accounts that violate these Terms or act in bad faith. In most cases, users will be notified in advance unless immediate action is warranted.

9. Dispute Resolution
Disputes between users and WhoBuilt will be resolved in good faith via email correspondence: info@whobuilt.com.au. Legal action may be pursued if a resolution cannot be reached.

10. Liability and Indemnity

10.1 Limitation of Liability
To the fullest extent permitted by law, WhoBuilt excludes liability for indirect, incidental, consequential, punitive, or special damages, including loss of profits, data, business opportunities, or goodwill. Aggregate liability will not exceed fees paid to WhoBuilt in the 12 months preceding a claim. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot be excluded by law.

10.2 Indemnity
You agree to indemnify and hold harmless WhoBuilt, its staff, and affiliates from any claims, liabilities, or damages resulting from your breach of these Terms, content you upload, or disputes with other users.

11. Data and Privacy

11.1 Data Collection and Storage
We collect personal and business data for user account management and platform functionality. All data is securely stored.

11.2 User Control
Users may delete their own profiles and uploads at any time. However, previously published promotional content will not be deleted even if the associated profile is removed.

11.3 Data Retention
WhoBuilt retains user data indefinitely for operational, legal, and historical purposes. Public visibility is limited to content selected for marketing.

12. External Services
WhoBuilt integrates:

* Google Maps to display project locations
* Stripe for secure payment processing
Use of these services is subject to their respective terms and conditions.

13. Governing Law
These Terms are governed by the laws of Australia. You agree to submit to the exclusive jurisdiction of the courts of South Australia.

WhoBuilt provides a platform to connect users with building professionals. We are not a party to any contract, agreement, or transaction resulting from a quote request. Professionals are not obligated to respond. WhoBuilt is not responsible if a professional does not reply.

18. User Responsibility
Users submitting quote requests must provide accurate information. WhoBuilt is not responsible for incorrect, incomplete, or misleading information.

19. Professional Responsibility
Professionals receiving quote requests are solely responsible for evaluating, responding to, and fulfilling any requests. WhoBuilt is not liable for any actions, errors, omissions, or misconduct by professionals, including failure to complete a project up to standard, poor quality work, delays, or communication issues.

20. Information Sharing and Privacy
By submitting a quote request, you consent to your information being shared with the selected professional. WhoBuilt will not use your information for any purpose other than facilitating the quote.

21. Attachments and Emails
Files uploaded by users or generated by the quote system are shared with the selected professional and included in email notifications to both parties. WhoBuilt disclaims all liability for any loss, damage, or misuse of submitted files or any images/information leaked outside the platform.

22. No Endorsement or Warranty
WhoBuilt does not guarantee the accuracy, reliability, suitability, or integrity of any professional or quote. Users engage with professionals at their own risk.

23. Non-Account User Consent
For users without a WhoBuilt account, submission of a quote constitutes acceptance of the Terms and Conditions and Privacy Policy.
